It seems this same company had sued Microsoft and succeeded, but I believe they came to an agreeable settlement after Microsoft decided to purchase a large portion of said company.
That being said, a company that's partly owned by Microsoft has much less impetus to settle with Sony.
Should Sony lose the suit, it may mean that Sony doesn't have the right to sell rumble-enabled controllers. Should they succeed, Microsoft will probably go back and sue the company to reclaim their settlement.
